Agreement to these terms
By creating an account, accepting an invite, connecting Google or YouTube, uploading content, visiting thumbnailmafia.com, or otherwise using Thumbnail Mafia ™, you agree to these Terms of Service and the Privacy Policy.
If you use Thumbnail Mafia ™ for a channel, company, agency, client, or other organization, you represent that you are authorized to bind that organization. If you do not agree, do not use the service.
Eligibility and accounts
You must be at least 13 years old and legally able to enter into these terms. If you are under 18, you may use the service only with permission from a parent or legal guardian.
You are responsible for accurate account information, credential security, invited users, workspace permissions, connected accounts, devices, and activity under your account. Notify us promptly if you believe your account or workspace has been compromised.
The service
Thumbnail Mafia ™ helps YouTube teams organize channels, video projects, thumbnail options, review rounds, comments, reactions, approvals, profile pages, invites, and selected Google or YouTube imports.
Features may be added, changed, suspended, limited, or removed over time. We may set reasonable limits on storage, file size, uploads, bandwidth, API usage, accounts, invites, and other operational areas.
User Content ownership and license
Users retain ownership of their content, including uploaded thumbnails, videos, profile media, comments, channel materials, feedback, files, and related creative assets.
You grant Thumbnail Mafia ™ a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, display, transmit, adapt for technical formatting, create previews, back up, and share User Content with authorized users as needed to provide, secure, support, maintain, and improve the service.
You are responsible for having rights, permissions, releases, and consents for content you upload, import, share, review, or approve through the service. Do not upload content that infringes rights, violates law, breaches confidentiality, or exposes private information without permission.
Workspace access and collaboration
Channel owners, administrators, project participants, thumbnail artists, reviewers, invitees, and other authorized users may be able to view, comment on, download, react to, or otherwise interact with User Content based on permissions and workflow settings.
You are responsible for inviting the right people and managing access to sensitive projects. Thumbnail Mafia ™ is not responsible for actions taken by users you invite or by people who gain access through your account, device, email, or workspace permissions.
Acceptable use
Do not upload unlawful, infringing, deceptive, abusive, harassing, hateful, exploitative, sexually explicit, malicious, or harmful content. Do not impersonate others, spam users, misrepresent permissions, manipulate feedback, or send unauthorized commercial messages.
Do not attempt unauthorized access, bypass security controls, scan systems, overload infrastructure, reverse engineer non-public systems, scrape private data at scale, interfere with service operations, or misuse Google, YouTube, or other third-party data.
Google, YouTube, and third-party services
When you connect Google or YouTube, you authorize Thumbnail Mafia ™ to use requested API access for channel connection, video import, media sync, and workflow features you initiate. Your use of connected features must also comply with applicable Google terms, YouTube terms, and the Google API Services User Data Policy.
We are not responsible for third-party services, API changes, outages, account restrictions, data returned by third-party providers, or actions taken by Google, YouTube, cloud providers, identity providers, analytics providers, or other services.
Privacy and data protection
The Privacy Policy explains how Thumbnail Mafia ™ collects, uses, shares, retains, and protects information. By using the service, you agree that we may process information as described there.
You are responsible for privacy notices, permissions, and consents needed for people, brands, clients, teams, or third parties whose information or content you upload, invite, or manage through the service.
Backups, security, and data loss
Thumbnail Mafia ™ uses reasonable operational safeguards, but no service can guarantee uninterrupted access, perfect security, permanent storage, or complete recovery of every file or record.
You should keep independent backups of important thumbnails, source files, deliverables, approvals, and business records. To the fullest extent permitted by law, Thumbnail Mafia ™ is not responsible for lost, corrupted, deleted, or compromised User Content, and is not liable for unauthorized access, security incidents, or data loss caused by account compromise, user error, third-party services, attacks, outages, force majeure events, or circumstances outside our reasonable control.
Copyright and DMCA notices
We respect intellectual property rights and may remove or restrict access to content alleged to infringe copyright, terminate repeat infringers, or take other appropriate action.
Copyright notices should be sent to legal@thumbnailmafia.com and should include: a signature of the copyright owner or authorized agent; identification of the copyrighted work; identification of the allegedly infringing material and where it appears; contact information; a good-faith statement that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and the sender is authorized to act for the owner.
If you believe your content was removed by mistake, you may send a counter-notice with the information required by law. We may restore content or forward notices as permitted or required by law.
Service availability and beta features
We may update, modify, limit, or discontinue parts of the service. Beta or experimental features may be incomplete, changed, reset, or discontinued at any time.
We do not guarantee YouTube performance, click-through rate, revenue, audience growth, video results, creative quality, availability of any third-party platform, or that feedback will be accurate, useful, lawful, or complete.
Suspension and termination
You may stop using the service at any time. We may suspend, restrict, or terminate access if we believe you violated these terms, created legal or security risk, infringed rights, abused the service, failed to pay applicable fees, or caused harm to users, third parties, or Thumbnail Mafia ™.
After termination, provisions about ownership, license cleanup, privacy, payment obligations, disclaimers, liability limits, indemnity, disputes, and interpretation continue as needed.
Disclaimers and liability limits
Thumbnail Mafia ™ is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted operation.
To the fullest extent permitted by law, Thumbnail Mafia ™ and its owners, employees, contractors, service providers, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, business interruption, reputational harm, security incidents, unauthorized access, third-party conduct, or third-party service failures.
To the fullest extent permitted by law, our total liability for any claim relating to the service or these terms will not exceed the greater of the amount you paid to Thumbnail Mafia ™ for the service during the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limits, so some limits may not apply to you.
Indemnity, governing law, and contact
You will defend, indemnify, and hold harmless Thumbnail Mafia ™ and its owners, employees, contractors, service providers, affiliates, and agents from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, use of the service, violation of these terms, violation of law, workspace invites or permissions, or infringement or misuse of another person's rights.
Unless mandatory law gives you different rights, these terms are governed by the laws of the U.S. state where Thumbnail Mafia ™ is organized or primarily operates, without regard to conflict-of-law rules. Venue for disputes will be in the state or federal courts located in that jurisdiction unless the parties agree otherwise or mandatory law requires another venue.
